A BILL FOR AN ACT

 

relating to county zoning.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46- County zoning; prohibition of fowl in residential areas. (a) Notwithstanding chapter 165 or any other law to the contrary, each county shall prohibit by ordinance the raising, breeding, and keeping of fowl in residential areas.

(b) Any person who violates an ordinance adopted by a county pursuant to this section shall be fined not more than $         for each separate offense. Each date of violation shall constitute a separate offense. Any action taken to impose or collect the penalty provided for in this subsection shall be considered a civil action.

(c) As used in this section:

"Fowl" includes domestic hens, roosters, and other poultry and any gamecocks or other fighting fowl.

"Residential area" means an area in a county that is zoned for single-family detached residences, duplexes, and other types of cluster or common-wall housing apartments."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
