A BILL FOR AN ACT

 

relating to human resources.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to exempt the University of Hawaii from the requirement to abolish a position whose incumbent elected to accept separation incentives provided for by part V, Act 253, Session Laws of Hawaii 2000.

SECTION 2. Act 253, Session Laws of Hawaii 2000, part V, is amended by amending section 118 to read as follows:

"SECTION 118. After payments of all costs associated with the voluntary severance and special retirement incentive benefits, the remaining payroll balances shall not be expended for any purpose and shall be lapsed into the appropriate fund[.], except for the remaining payroll balances of the University of Hawaii, which shall remain with the University of Hawaii."

SECTION 3. Act 253, Session Laws of Hawaii 2000, part V, is amended by amending section 119 to read as follows:

"SECTION 119. [The](a) Except for the University of Hawaii, the head of each affected state department who provided benefits under this part shall:

(1) Transmit a report of every position identified for abolishment and vacated under this part to the directors of finance and human resources development who shall abolish these positions from the appropriate budget and personnel files. The governor shall report this information to the legislature no later than twenty days prior to the convening of each regular session beginning with 2001;

(2) Reduce its personnel count by every position identified for abolishment and vacated under this part, whether the former incumbent vacated the position as a result of accepting a voluntary severance benefit or special retirement incentive benefit authorized under this part or of exercising reduction-in-force rights; and

(3) Transmit a list that includes each employee who received benefits under this part and the benefit received by the employee to the directors of finance and human resources development.

(b) The University of Hawaii shall transmit to the governor and directors of finance and human resources development the name of each employee whose position was abolished or directly affected by a reduction-in-force or a workplace restructuring plan who received benefits under this part and the benefits received by the employee. The governor shall report this information to the legislature no later than twenty days prior to the convening of each regular session beginning with the regular session of 2004. The University of Hawaii may retain every position affected and redescribe it to modernize business practices."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2020.
