A BILL FOR AN ACT

 

relating to the public land trust.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. During the 2000 legislative session, the legislature passed Act 125, the purpose of which was to facilitate the establishment of a comprehensive information system to conduct an inventory and maintain information about the lands of the public land trust described in section 5(f) of the Admission Act and article XII, section 4, of the State Constitution. In accordance with section 5(a) of Act 125, the auditor is to report to the legislature the system's progress towards completion as well as any legislation the auditor deems necessary to facilitate the expeditious completion of the inventories and system. Thus far, the auditor has determined that a greater amount of funding than previously calculated is necessary. Although such state funding is not currently available to finance the entire cost, the legislature is committed to funding this undertaking at a level that will ensure meaningful progress towards the completion of the system.

SECTION 2. Chapter 23, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§23- Public land trust inventory special fund. (a) There is created in the state treasury a special fund to be designated as the public land trust inventory special fund into which shall be deposited:

(1) Appropriations by the legislature; and

(2) Moneys transferred from the special land and development fund.

(b) The proceeds in the fund shall be used to facilitate the establishment of a comprehensive information system for inventorying and maintaining information about the lands of the public land trust described in section 5(f) of the Admission Act and article XII, section 4 of the state constitution."

SECTION 3. There is appropriated out of the special land and development fund the sum of $        or so much thereof as may be necessary for fiscal year 2003-2004 to be paid into the public land trust inventory special fund.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 4. There is appropriated out of the public land trust inventory special fund the sum of $        or so much thereof as may be necessary for fiscal year 2003-2004 to carry out the purposes of Act 125, Session Laws of Hawaii 2000.

The sum appropriated shall be expended by the office of the auditor for the purposes of this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect on July 1, 2003.
