A BILL FOR AN ACT

 

RELATING TO CREDIT CARD TRANSACTIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is a growing problem in our State, and across the nation, of identity theft and credit card fraud. Police currently receive between twelve and thirty complaints a day relating to fraudulent use of credit cards, identity theft, or forgery. The legislature finds that Hawaii needs to be proactive in passing legislation limiting public access to the consumer's credit card number rather than waiting for federal legislation.

SECTION 2. Chapter 476, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§476-    Credit card receipts; limited information. (a) Except as provided in this section, no person that accepts credit cards for the transaction of business shall print more than the last five digits of the credit card account number or the expiration date upon any receipt provided to the cardholder.

(b) This section applies only to receipts that are electronically printed and does not apply to transactions in which the sole means of recording the person's credit card number is by handwriting or by an imprint or copy of the credit card.

(c) A civil penalty of $250 shall be imposed for the first violation of this section. A civil penalty of $1,000 shall be imposed for each violation thereafter."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on January 1, 2005, with respect to any receipt printed using a cash register or other machine or device that is first put into use on or after January 1, 2005. This Act shall take effect on January 1, 2006, with respect to any receipt printed using a cash register or other machine or device that is in use before January 1, 2005.
