A BILL FOR AN ACT

 

RELATING TO STATE FUNDS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

PART I

SECTION 1. The legislature finds that expenditures from the emergency and budget reserve fund established by section 328L-3, Hawaii Revised Statutes, are needed to meet the emergency economic situation currently facing the State. The legislature determines that the moneys are urgently needed to maintain levels of programs that are essential to the public health, safety, and welfare. The legislature further finds that the grants and subsidies under this Act are in the public interest and serve the public health, safety, and welfare.

PART II

SECTION 2. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $300,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to Volunteer Legal Services Hawaii for its Na Keiki Law Center project focusing on protecting the legal rights of children.

The sum appropriated shall be expended by the department of labor and industrial relations, office of community services, for the purposes of this Act.

PART III

SECTION 3. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2004-2005 pursuant to chapter 103F, Hawaii Revised Statutes, to provide treatment services for child victims of intrafamilial sexual abuse, including psychological treatment and case management services for child victims and their families who are not covered under the child protective services system of the department of human services.

The sum appropriated shall be expended by the judiciary via the children's justice center for the purposes of this Act.

SECTION 4. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $175,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Domestic Violence Clearinghouse and Legal Hotline for Maui program services.

The sum appropriated shall be expended by the judiciary, circuit court of the second circuit, for the purposes of this Act.

SECTION 5. The sums appropriated in this part shall be expended by the housing and community development corporation of Hawaii for the purposes of this Act.

PART IV

SECTION 6. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $300,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the bridge to hope program, including one position for outreach; provided that if federal funds are made available to fund any portion of bridge to hope Temporary Assistance to Needy Families program participant costs, then the sum appropriated by this section shall be reduced by the amount of federal funds received, and the state funds that were replaced by federal funds shall lapse to the emergency and budget reserve fund.

The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

PART V

SECTION 7. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $90,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to Hale Mahaolu for the personal care program for disabled or chronically ill frail adults and elders residing in Maui county.

SECTION 8. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Youth Services Network for its Transitional Living Program for Unserved Street Youth.

SECTION 9. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $105,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Hui Malama Learning Center for alternative education services for Maui's at-risk youth.

SECTION 10. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Adult Friends for Youth for the youth gang prevention and rehabilitation program.

SECTION 11. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $190,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Family Support Services of West Hawaii for family centers in North Hawaii and in Ka'u on the island of Hawaii.

SECTION 12. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $15,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Hale Ipu Kukui Alakai for programs for money management skills and education to consumers of mental health services and others with disabilities.

SECTION 13. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $79,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, to Hawaii FI-DO Service Dogs to support activities and projects that raise, train, and place service dogs with residents who have disabilities other than blindness.

SECTION 14. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $250,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Sea of Dreams for the digital ride, mobile technology for community project.

SECTION 15. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $40,140 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Molokai Occupational Center for the work activities certification project.

SECTION 16. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for World Youth Network for the character education program for students in grades K-1.

SECTION 17. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Parents and Children Together for programs on child development, parenting skills, and other programs that foster positive environments between parents and their children.

SECTION 18. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $231,746 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Parents and Children Together for an economic development center.

SECTION 19. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Kalihi YMCA.

SECTION 20. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Roman Catholic Church in Hawaii for a full service-mobile healthcare program that provides primary dental services for uninsured.

SECTION 21. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Friends of Foster Kids to develop infrastructure to transition into a professional child welfare services agency.

SECTION 22. There is appropriated out of the emergency and budget reserve fund the sum of $1,000,000 or so much thereof as may be necessary for fiscal year 2004-2005 pursuant to chapter 103F, Hawaii Revised Statutes, for costs related to homeless assistance.

SECTION 23. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $290,518 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Self-Help Housing Corporation of Hawaii for self-help housing technical services.

SECTION 24. The sums appropriated in this part shall be expended by the department of human services for their respective purposes; provided that the sum appropriated in section 10 shall be expended by the office of youth services; and provided that the sums appropriated in sections 22 and 23 shall be expended by the housing and community development corporation of Hawaii for the purposes of this Act.

PART VI

SECTION 25. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $75,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Catholic Charities of the Diocese of Honolulu for the Lanakila Multi-Purpose Senior Center.

SECTION 26. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $60,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Moiliili Community Center for program support.

SECTION 27. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $50,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Waikiki Community Center for program support.

SECTION 28. The sums appropriated in this part shall be expended by the executive office of aging for the purposes of this Act.

PART VII

SECTION 29. There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $96,152 or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Na Lei Wili AHEC to support the health of underserved communities through the education and development of the community's caregivers.

SECTION 30. There is appropriated out of the emergency and budget reserve fund the sum of $750,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to Molokai General Hospital.

SECTION 31. There is appropriated out of the emergency and budget reserve fund the sum of $750,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to Kahuku hospital to fund the costs of emergency room operations, inpatient and outpatient care for the underinsured, medical malpractice insurance, and labor.

SECTION 32. There is appropriated out of the emergency and budget reserve fund the sum of $750,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to the Waianae Coast Comprehensive Health and Hospital Board, Inc., to fund its operations and programs.

SECTION 33. There is appropriated out of the emergency and budget reserve fund the sum of $250,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, for Wahiawa General Hospital to provide indigent care services.

SECTION 34. There is appropriated out of the emergency and budget reserve fund the sum of $200,000 or so much thereof as may be necessary for fiscal year 2004-2005 pursuant to chapter 103F, Hawaii Revised Statutes, to enable the department of health to operate a hospital-based poison center twenty-four hours a day.

SECTION 35. There is appropriated out of the emergency and budget reserve fund the sum of $750,000 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to the Hana Community Health Clinic for its operations and care services for uninsured patients.

SECTION 36. There is appropriated out of the emergency and budget reserve fund the sum of $787,900 or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, for the Kapiolani Medical Center for Women and Children Sex Abuse Treatment Center master contract.

SECTION 37. There is appropriated out of the emergency and budget reserve fund the sum of $750,000, or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, for Kauai Community Health Center including their indigent dental services program.

SECTION 38. There is appropriated out of the emergency and budget reserve fund the sum of $375,000, or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for Maui Economic Opportunity, Inc. and its night transportation for dialysis treatment programs in Maui County.

SECTION 39. There is appropriated out of the emergency and budget reserve fund the sum of $200,000, or so much thereof as may be necessary for fiscal year 2004-2005 as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, with $100,000 for the Hawaii Drug Assistance Program (HDAP), and $100,000 for Hawaii Seropositivity and Medical Management Program (HSPAMM).

SECTION 40. There is appropriated out of the emergency and budget reserve fund the sum of $300,000, or so much thereof as may be necessary for fiscal year 2004-2005 as a grant pursuant to chapter 42F, Hawaii Revised Statutes, for the Waipahu Community Adult Day Health Center and Youth Day Care Center pilot project.

SECTION 41. There is appropriated out of the emergency and budget reserve fund the sum of $75,000, or so much thereof as may be necessary for fiscal year 2004-2005, as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to the St. Francis Medical Center for the operations of the bone marrow registry.

SECTION 42. There is appropriated out of the emergency and budget reserve fund the sum of $31,000, or so much thereof as may be necessary for fiscal year 2004-2005, as a subsidy pursuant to chapter 42F, Hawaii Revised Statutes, to the donated dental services program.

SECTION 43. The sums appropriated in this part shall be

expended by the department of health for their respective

purposes.

PART XIII

SECTION 44. This Act shall take effect on July 1, 2004.
