A BILL FOR AN ACT

 

RELATING TO INFORMATION PRACTICES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 201B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§201B-   Hawaii convention center licensees records; confidentiality. (a) Booking business records relating to Hawaii convention center licensees shall not be subject to disclosure under chapter 92F if the authority, upon request of a licensee, determines that disclosure may result in:

(1) Disclosure of booking business information that would place the convention center at a competitive disadvantage in negotiations with a potential licensee of the convention center;

(2) Disclosure of a potential licensee's proprietary information or business strategy; or

(3) The loss of a convention center booking.

(b) Subsection (a) shall not apply to disclosure to the legislature.

(c) As used in this section, "booking business records" means the company name, address, and contact; event program contents; event schedules; exhibitor lists; confidential business information; and description of the Hawaii convention center's offer, rent, discounts, and subsidies."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
