A BILL FOR AN ACT

 

making an appropriation for the purchase of land in pupukea-paumalu, oahu.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The Pupukea-Paumalu area (area) on the north shore of Oahu consists of 1,129 acres and is bordered by the Paumalu gulch, Pupukea-Paumalu forest reserve, and the Kalunawaikaala gulch and stream.

The legislature finds that the area includes important coastal scenic views of the Koolau and Waianae mountain ranges, in addition to a wide variety of cultural, historic, environmental, open space, visual, and recreational resources. Its unique features attract tourists to the north shore of Oahu and thereby provide economic support for the rural community. Additionally, the area creates a buffer between the north shore community and the extensive military activity in the surrounding area. Two state water reserves and several watersheds are located within the boundaries of the area.

The area is presently being offered for sale. The legislature further finds that this is a unique opportunity that deserves the support of the State.

The purpose of this Act is to appropriate moneys toward the purchase of the area.

SECTION 2. The department of land and natural resources shall:

(1) Determine the best option to purchase the Pupukea-Paumalu area, including a public-private partnership, government-community consortium, obtaining federal matching funds, and land exchange, and

(2) In making its determination, consider the protection of the parcel's agricultural and conservation uses.

SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $1 and the same sum is appropriated, or so much thereof as may be necessary for fiscal year 2004-2005, for the purchase of the one thousand one hundred and twenty-nine acres on the north shore of Oahu bordered by Paumalu gulch, Pupukea-Paumalu forest reserve, and the Kalunawaikaala gulch and stream; provided that no funds shall be made available under this Act unless the department of land and natural resources obtains matching federal funds for the purpose for which this sum is appropriated.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 4. The appropriation made for the acquisition authorized by this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all appropriations which are unencumbered as of June 30, 2006, shall lapse as of that date.

SECTION 5. This Act shall take effect on July 1, 2020.
