A BILL FOR AN ACT

 

relating to storage of waste.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 340A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§340A-    Storage of solid waste; time limit. To the extent that the temporary storage of solid waste is permitted under this chapter, the director of health shall adopt rules in accordance with chapter 91 to set a time limit on such storage in the State by any person. For the purpose of this section, "storage" means the collecting, transporting, stockpiling, and storing of solid waste for a temporary period in a manner that does not constitute disposal."

SECTION 2. Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342G-    Storage of solid waste; time limit. To the extent that the temporary storage of solid waste is permitted under this chapter, the director of health shall adopt rules in accordance with chapter 91 to set a time limit on such storage in the State by any person. For the purpose of this section, "storage" means the collecting, transporting, stockpiling, and storing of solid waste for a temporary period in a manner that does not constitute disposal."

SECTION 3. Chapter 342I, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342I-    Storage of special waste; time limit. To the extent that the temporary storage of special waste is permitted under this chapter, the director of health shall adopt rules in accordance with chapter 91 to set a time limit on such storage in the State by any person. For the purpose of this section, "storage" means the collecting, transporting, stockpiling, and storing of special waste for a temporary period in a manner that does not constitute disposal."

SECTION 4. Chapter 342H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342H-    Storage of special waste; time limit. To the extent that the temporary storage of special waste is permitted under this chapter, the director of health shall adopt rules in accordance with chapter 91 to set a time limit on such storage in the State by any person. For the purpose of this section, "storage" means the collecting, transporting, stockpiling, and storing of special waste for a temporary period in a manner that does not constitute disposal."

SECTION 5. Chapter 342J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342J-    Storage of hazardous waste; time limit. To the extent that the temporary storage of hazardous waste is permitted under this chapter, the director of health shall adopt rules in accordance with chapter 91 to set a time limit on such storage in the State by any person. For the purpose of this section, "storage" has the meaning as defined in section 342J-2."

SECTION 6. New statutory material is underscored.

SECTION 7. This Act shall take effect upon its approval.
