A BILL FOR AN ACT

 

relating to the south kona wilderness area.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2004-2005 for the purpose of conducting an appraisal of private lands contained within the South Kona wilderness area. The findings of the appraisal shall be used as a basis for acquiring the private lands either through purchase or through a value-for-value land exchange of other state lands.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act; provided that:

(1) The department of land and natural resources shall report back to the legislature with its findings no later than twenty days prior to convening of the regular session of 2005; and

(2) No purchase or land exchange of private lands within the South Kona wilderness area shall take place until after the department of land and natural resources has submitted its report to the legislature.

SECTION 2. This Act shall take effect on July 1, 2004.
