A BILL FOR AN ACT

 

relating to energy projectories.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"321- Energy projectories investigation, assessment, and rulemaking. (a) The department of health shall receive complaints and, if appropriate, investigate reported incidents of damage or injuries caused by energy projectories throughout the State. From data collected through its investigations, the department shall assess the prevalence of damage or injuries caused by energy projectories, develop standards, and adopt rules under chapter 91 as needed to regulate energy projectories and to limit their associated hazards. The department shall also take appropriate steps to educate the public on the safe use of products in order to minimize the risk of damage or injury from energy projectories.

(b) As used in this section, "energy projectories" means electromagnetic waves from sources such as microwaves, radiation, pulse, sound waves, radio waves, and light waves."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $         , or so much thereof as may be necessary for fiscal year 2004-2005, to be expended by the department of health for the purposes of this Act.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
