A BILL FOR AN ACT

 

relating to noise abatement.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 342F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342F- Vehicular noise control; administrative rules. The director shall adopt rules under chapter 91 to regulate commercial vehicular noise in the early morning hours similar to those of department of health rules on the same subject that were repealed in 2000."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2004-2005, for enforcement by health authorities and appropriate law enforcement officers, as well as for decibel meters, to ensure that the administrative rules required by section 342F- , Hawaii Revised Statutes, are effectively executed and enforced.

SECTION 3. The sum appropriated shall be expended by the department of health for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval; provided that sections 2 and 3 shall take effect on July 1, 2004.
