A BILL FOR AN ACT

 

RELATING TO COMPENSATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 388, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART . BROADCASTING COMPANIES

COMPENSATION BY COMMISSION

§388-A Definitions. As used in this part, unless the context otherwise provides:

"Advertisement" means all representations disseminated by radio or television for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of any goods or services.

"Broadcasting company" means any private company, corporation or entity that broadcasts programs on radio or television pursuant to a license issued by the Federal Communications Commission.

"Sales agent" means any person who works for a broadcasting company soliciting advertisements on a commission basis.

§388-B Payment of commissions. A broadcasting company that employs or retains any sales agent in an agency relationship shall pay any commissions, at the rate agreed upon by the broadcasting company and the agent, within sixty days, without reduction, from the initial broadcast of any advertisement that the sales agent has successfully solicited for the broadcasting company, notwithstanding whether the broadcasting company has received payment for the broadcasting of the advertisement."

SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

SECTION 3. This Act shall take effect upon its approval.
