A BILL FOR AN ACT

 

relating to the judicial selection commission.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to require the judicial selection commission, which was established under article VI, section 4, of the Hawaii Constitution, to:

(1) Rotate the appointing authority for neighbor island

members of the commission;

(2) Require member biographies to be made available to the

public; and

(3) Prohibit members from having a direct interest in the

success or failure of ballot questions or political

candidates when appointed, or actively support or

oppose a political candidate or ballot question while

serving as a member of the commission.

SECTION 2. The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

judicial selection commission

§   -1 Member appointment. One member of the judicial selection commission shall be a resident of a county other than the city and county of Honolulu, and shall be appointed on a rotating basis by the governor, the president of the senate, the speaker of the house or representatives, and the chief justice of the supreme court, as provided by rule adopted by the commission.

§   -2 Publication. A written biography of each member of the judicial selection commission shall be made available to the public, including through publication over the Internet.

§   -3 Conflict of interest. No member of the judicial selection commission shall:

(1) Possess a direct interest in either the success or failure of a political candidate or ballot question when appointed; or

(2) Actively support or oppose a political candidate or ballot question while serving as a member of the commission."

SECTION 3. This Act shall take effect upon its approval.
