A BILL FOR AN ACT

 

RELATING TO ELECTIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:

11-    Manual recount of votes cast. (a) Notwithstanding any law to the contrary, any registered voter who voted in the last sixty days or any qualified political party, may request of the chief election officer, a manual recount of any precinct election result provided that the requesting voter or political party:

(1) Files a written request with the chief election officer within five days of an election;

(2) Deposits with the chief election officer a fee of $200 for the first precinct requested to be recounted and $50 for each additional precinct requested to be recounted; and

(3) Pays an additional fee of 25 cents for each ballot that was counted during the manual recount.

The chief election officer may adopt rules under chapter 91 to implement this section in a fair, uniform, and impartial manner.

(b) Nothing in this section shall preclude the right to judicial proceedings under this chapter."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
