A BILL FOR AN ACT

 

relating to school health services.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that efforts by the department of health to maintain a dependable reserve of "on-call", substitute school health aides have not been very successful because it is difficult for these substitutes to earn a living wage solely through "on-call" work. The purpose of this Act is to ensure that all school health rooms are always staffed by qualified health personnel, by appropriating funds to provide school health aides with dependable substitutes.

SECTION 2. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to part XIX to be appropriately designated and to read as follows:

"§321-     Establishment of substitute system. (a) All school health rooms shall be staffed at all times by qualified health personnel.

(b) The department of health shall provide school health aides throughout the State with dependable substitutes in order to ensure that all school health rooms are staffed at all times by qualified health personnel."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $        , or so much thereof as may be necessary for fiscal year 2003-2004, and the same sum or so much thereof as may be necessary for fiscal year 2004-2005, for         , full-time equivalent (      FTE), temporary school health aide positions in order to provide school health aides throughout the State with dependable substitutes and ensure that all school health rooms are staffed at all times by qualified health personnel.

SECTION 4. The sums appropriated shall be expended by the department of health for the purposes of this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect on July 1, 2003.
