A BILL FOR AN ACT

 

RELATING TO SECURITY AT HAWAII HEALTH SYSTEMS CORPORATION HOSPITALS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to transfer security positions, employees, and authority from the department of public safety to the Hawaii health systems corporation. This transfer shall not impact the Hawaii health systems corporation's ability and authority to use private contractors at hospitals under its jurisdiction.

SECTION 2. Section 26-14.6, Hawaii Revised Statutes, is amended by amending subsection (i) to read as follows:

"(i) Effective January 1, 1993, the functions and authority heretofore exercised by the director of health and the department of health relating to uniformed security employees and security contracts at various state hospitals throughout the State shall be transferred to the department of public safety. Effective July 1, 2004, the functions and authority relating to uniformed security employees and security contracts at the health facilities under the operation, management, and control of the Hawaii health systems corporation shall be transferred to the Hawaii health systems corporation."

SECTION 3. All officers or employees of the department of public safety whose positions are transferred by this Act shall be transferred to the Hawaii health systems corporation. The functions, duties, classification, pay, benefits, tenure, seniority, prior service credit, vacation, sick leave, or other employee benefit or privilege of any officer or employee shall not be changed in the execution of the transfer. Subsequent changes in status shall be made in accordance with applicable state and Hawaii health systems corporation personnel laws, rules, policies, procedures, and collective bargaining agreements.

If an office or position held by an officer or employee is abolished as a result of this Act, the employment action affecting the officer or employee shall be in accordance with applicable state personnel laws, rules, policies, procedures, and collective bargaining agreements.

SECTION 4. All appropriations, records, equipment, files, supplies, contracts, books, papers, documents, maps, computer software and data, authorizations, and other property, both real and personal, heretofore made, used, acquired, or held by the department of public safety in the exercise of the functions and programs transferred by this Act shall be transferred to the Hawaii health systems corporation along with the functions or programs.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect on July 1, 2004.
