A BILL FOR AN ACT
RELATING TO ANIMAL CONTROL FROM AIRCRAFT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 263-10, Hawaii Revised Statutes, is amended to read as follows:
"
§263-10 Hunting from aircraft; penalty. (a) Any aeronaut or passenger who, while in flight in, across or above the State, intentionally kills or attempts to kill any birds or animals shall be guilty of a misdemeanor and punished by a fine of not [(b) Subsection (a) shall not apply to any authorized employee or agent of any federal agency that obtains the approval of the department of land and natural resources and the applicable landowner to conduct animal control activities from aircraft for the sole purpose of conducting conservation programs on state, county, or private land."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval
