A BILL FOR AN ACT

 

relating to AN inactive license for professional and vocational licensees.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 436B, Hawaii Revised Statutes, is

amended by adding a new section to be appropriately designated to read as follows:

"§436B- _ Inactive licenses. (a) Notwithstanding any other provision of law or rule to the contrary, a licensee may:

(1) Place the licensee's active license on an inactive status. Upon receipt of a written request from the licensee to place the license on inactive status, the licensing authority shall change the licensee's status from active to inactive at no cost to the licensee. The licensee may reactivate the license by completing a reactivation form and fulfilling any other requirements established by the licensing laws or rules for the respective profession or vocation and by this chapter. No fee shall be assessed if the license is reactivated prior to the expiration date of the current license;

(2) During the license renewal period, renew the license on an inactive status. The renewal fee for an inactive license shall be set at seventy-five per cent of the renewal fee for an active license. Upon receipt of a completed renewal form to place the license on inactive status and payment of the applicable fees, the licensing authority shall renew the license on an inactive status; and

(3) After renewing an inactive license, reactivate the license. The licensee shall complete a reactivation form, fulfill any other requirements established by the licensing laws or rules for the respective profession or vocation and by this chapter, and pay twenty-five per cent of the active license fee.

(b) While on an inactive status, a licensee shall not engage in any activity in the licensee's profession that would require an active license. Any person who violates this prohibition shall be subject to discipline under this chapter and the licensing laws or rules for the respective profession or vocation.

(c) The compliance resolution fund fee, education and recovery trust fund fees, or other fees required with licensure and renewal shall be as otherwise provided by law."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
