A BILL FOR AN ACT

 

relating to procurement.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§103D-    Subcontracting; wages; all union agreement. (a) A bidder for construction work shall file a sworn statement with the department of labor and industrial relations specifying that the construction work, if performed in whole or in part by a subcontractor of the bidder, will be performed by employees who are:

(1) Paid the prevailing rate of compensation, including benefits; and

(2) Working under the terms and conditions of employment

as persons employed by the bidder.

(b) The sworn statement shall be filed in a form and manner prescribed by the director of labor and industrial relations.

(c) This section shall apply only to a bidder who is subject to an "all union agreement", as that term is defined in section 377-1.

(d) This section shall apply to all bids for construction work issued after December 31, 2004."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
