A BILL FOR AN ACT

 

relating to employee organizations.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that parent unions based on the mainland collect annual union fees and dues from their local affiliates, branches, or subsidiaries. These union fees and dues are substantial and are remitted to the parent unions on the mainland. However, local affiliates in Hawaii never receive any benefit from those union fees, to the detriment of their members. This not only is this inequitable for local union employees, but also creates a financial drain on Hawaii's economy as resources are siphoned out of the State. The purpose of this Act is to require parent unions based on the mainland to return to Hawaii's union members at least fifty per cent of the union fees and dues collected annually in any form that is appropriate, whether it is cash, vacation leave, sick leave, or strike benefits.

SECTION 2. As a condition for doing business in Hawaii, all parent labor unions based on the mainland shall return to their local affiliates, branches, or subsidiaries in Hawaii at least fifty per cent of all union fees or dues collected annually in any form that is appropriate and agreed upon between the parent and the local affiliate, branch, or subsidiary, whether it is in the form of cash, vacation leave, sick leave, or strike benefits. The parent union shall not increase its union fees or dues that it collects specifically for the purpose of offsetting the return of a percentage of union fees or dues.

SECTION 3. This Act shall take effect upon its approval.
