A BILL FOR AN ACT

 

relating to the employees' retirement system.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 88, Hawaii Revised Statutes, is amended by adding a new section to part VII to be appropriately designated and to read as follows:

"§88- Service while legislative employee. In addition to any other service credit provided under this chapter, any member that is employed as a per diem employee of the legislature while the legislature is not in session and who subsequently becomes a full time employee of the legislature shall have the member's per diem service credited as part of the member's full time employment service credit."

SECTION 2. Section 88-54, Hawaii Revised Statutes, is amended to read as follows:

"§88-54 Service while legislative employee. (a) Any member who takes a leave of absence to be employed by the legislature during any legislative session shall be entitled to all benefits and required to make all employee contributions under the system for the period during which such employee worked for the legislature; provided that the contributions shall be made on the same basis as would have been required had the employee not been on leave of absence.

(b) Any member that is employed as a per diem employee of the legislature while the legislature is not in session and who subsequently becomes a full time employee of the legislature shall have the member's per diem service credited as part of the member's full time employment service credit."

SECTION 3. An active member of the employees' retirement system that was previously employed as a per diem employee of the legislature while the legislature was not in session and who subsequently became a full time employee of the legislature prior to the effective date of this Act is entitled to claim the per diem service as creditable service towards retirement. An active member of the employees' retirement system seeking to claim the service credit authorized under this Act shall have two years from the effective date of this Act to file a request with the employees' retirement service to claim the service credit.

SECTION 4. The employees' retirement system shall establish a process to enable active members of the employees' retirement system to either purchase service credit, in the case of contributory members, or receive service credit, in the case of noncontributory members.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect upon its approval.
