A BILL FOR AN ACT

 

RELATING TO EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to promote the health of Hawaii's children by limiting access to carbonated and sugary beverages. Studies have shown that more than twenty per cent of Hawaii's children are obese, a rate that is twice the national average. Soft drinks now comprise the leading source of added sugar in a child's diet and each additional daily serving of sugar-sweetened soda increases a child's risk for obesity by sixty per cent.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- School vending machines. Vending machines operating on school grounds shall only be permitted to dispense water, milk, and one hundred per cent fruit juice. All other beverages are prohibited from being dispensed from vending machines on school grounds."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on January 1, 2005.
