A BILL FOR AN ACT

 

RELATING TO CREDIT CARD OR DEBIT CARD REMITTANCES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 40, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§40- Credit card or debit card remittances. (a) Notwithstanding any law to the contrary, any department, agency, board, or commission shall permit the use of credit cards or debit cards for any remittance in excess of $10 made to that department, agency, board, or commission; provided that any department, agency, board, or commission may, for good cause, adopt rules pursuant to chapter 91 to exempt specified remittances from the requirements of this section. A service fee shall not be required by any department, agency, board, or commission for the use of debit card remittances, but may be required by any department, agency, board, or commission for the use of credit card remittances.

(b) As used in this section:

"Credit card" means any card, plate, coupon book, or other single credit device issued with or without fee by an issuer for the use of the cardholder in obtaining money, goods, services, or anything else of value, from time to time, on credit.

"Debit card" means any card, plate, or other single credit device issued with or without a fee to a cardholder to purchase goods or services, or to obtain cash that is debited from the cardholder's checking or other bank account."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on January 1, 2005.
