A BILL FOR AN ACT

 

relating to geographic exceptions.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-1143, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-1143[]] Attend school in what district. (a) All persons of school age shall be required to attend the school of the district in which they reside, unless it appears to the department to be desirable to allow the attendance of pupils at a school in some other district, in which case the department may grant this permission.

(b) Priority consideration for a geographic exception shall be given to applicants requesting an exception because of any of the following reasons:

(1) First priority. Implementation of public school choice, including the unsafe school choice option, in accordance with the No Child Left Behind Act of 2001 (P.L. No. 107-110);

(2) Second priority. Physical residence in the geographic attendance area of a new century conversion charter school as defined in section 302A-1191; and

(3) Third priority. Authorized physical residence in the receiving school's geographic attendance area; program of study of the receiving school that is not available at the home school; siblings of students currently enrolled in the receiving school who will continue to be enrolled in the coming school year; or children of staff at the receiving school.

The reasons for priority consideration listed in this paragraph are not ranked and each shall be given equal consideration.

(c) All other requests for geographic exceptions shall be considered only after priority requests have been accommodated.

(d) For the purposes of this section:

"Geographic exception" means permission to attend a school other than the student's home school as determined by the student's legal residence.

"Home school" means the school within the geographic attendance area to which the student is assigned according to the student's legal residence.

"Legal residence" means the residence of a student's parents, legal guardian, or legal custodian."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
