Description:

Authorizes a permanent full-time public employee who is exempt from chapters 76 and 89 but not an "excluded employee" as defined in section 89C-1.5, HRS to use more than 10 days per calendar year of sick leave for family leave purposes if so authorized by a valid employment policy.

A BILL FOR AN ACT

 

RELATING TO FAMILY LEAVE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 398-4, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

"(c) An employer who provides sick leave for employees shall permit an employee to use the employee's accrued and available sick leave for purposes of this chapter; provided that an employee shall not use more than ten days per year for this purpose unless an express provision of a valid collective bargaining agreement, or, in the case of a permanent full-time employee of the State or one of its political subdivisions who is exempt from chapters 76 and 89 but is not an "excluded employee" as defined in section 89C-1.5, a valid employment policy authorizes the use of more than ten days of sick leave for family leave purposes. Nothing in this section shall require an employer to diminish an employee's accrued and available sick leave below the amount required pursuant to section 392-41."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
