A BILL FOR AN ACT

 

relating to garnishment.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 652, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§652-   Administrative fee. For the purposes of garnishment, an employer may deduct and retain an additional administrative fee of $2 for each payment sequestered and delivered to the judgment creditor from week-to-week or from month-to-month, until the order, decree, or judgment, with legal interest thereon, is fully paid or until the judgment debtor is no longer employed or paid by the employer. This $2 administrative fee is assessed in addition to the amount or amounts awarded to the judgment creditor under the subject order, decree, or judgment, and shall not be deducted from such amount or amounts."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
