A BILL FOR AN ACT

 

relating to government boards, commissions, and agencies.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 92, Hawaii Revised Statutes, is amended by adding to part II a new section to be appropriately designated and to read as follows:

"§92- Nonattendance of board member; expiration of term. (a) Notwithstanding any law to the contrary, the term of a member of a board shall expire upon the failure of the member to attend two consecutive meetings duly noticed to all members of the board where the board failed to constitute quorum necessary to transact all aspects of its business. The expiration of the member's term shall be effective upon the adjournment of the second consecutive meeting. The vacancy shall be filled in the same manner as the original appointment. (b) This section shall not apply to ex officio members of a board."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
