A BILL FOR AN ACT

 

relating to hurricane shelters.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 127, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§127- Adoption of criteria for hurricane-resistant shelters; construction of new public school buildings. (a) The adjutant general shall adopt criteria for hurricane-resistant shelters in accordance with chapter 91 to regulate the planning, design, construction, and equipping of new public school buildings built after June 30, 2004, that are designated by the State or counties as hurricane shelters.

(b) The criteria for hurricane-resistant shelters established by the adjutant general on July 29, 1997, shall apply to the planning, design, construction, and equipping of all new public school buildings built before July 1, 2004, that are designated by the State or counties as hurricane shelters."

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:

"§302A- Construction of new school buildings' conformance with criteria for hurricane-resistant shelters. (a) All new school buildings planned, designed, constructed, and equipped before June 30, 2004, that are designated by the State or counties as hurricane shelters shall be built in accordance with the criteria for hurricane-resistant shelters adopted by the adjutant general pursuant to section 127- .

(b) To the maximum extent feasible, all new school buildings planned, designed, constructed, and equipped before July 1, 2004, that are designated by the State or counties as hurricane shelters shall be built in accordance with the criteria for hurricane-resistant shelters established by the adjutant general on July 29, 1997."

SECTION 3. The State shall seek funds from the Federal Emergency Management Agency to retrofit existing school cafeterias to be suitable as hurricane-resistant shelters.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
