A BILL FOR AN ACT

 

RELATING TO EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Act 158, Session Laws of Hawaii 2002, repealed the revolving fund for the department of education storeroom. The lease on the property and the materials themselves remain. While resolution of the lease is an issue best resolved by the department of education and the lessor, the location and the materials within represent an opportunity for Hawaii's teachers and the general public that must be capitalized upon.

The purpose of this Act is to create a program to facilitate the distribution of desired supplies to teachers at no cost and to the general public at a discounted price.

SECTION 2. All public schools located in counties with a population greater than 250,000 shall gather all unwanted or unnecessary supplies for delivery to the warehouse that housed the department of education storeroom established by Act 89, Session Laws of Hawaii 1996, and repealed by Act 158, Session Laws of Hawaii 2002, within ninety days of the effective date of this Act.

SECTION 3. After all schools have complied with section 2 of this Act, the department of education shall post an inventory listing of all supplies stored in the warehouse on the department's website.

SECTION 4. All public school teachers employed by a public school in a county with a population greater than 250,000 may go to the warehouse, select and take items for use in their respective classrooms at no charge, subject to the following conditions:

(1) All selections are based on a first-come, first-serve basis;

(2) Teachers need to show a valid identification card identifying themselves as a public school teacher; and

(3) Teachers that fail to select and take items within the period of time stated in section 5 of this Act shall be subject to the charging of the discounted price for any particular good as stated in section 5 of this Act.

SECTION 5. The department of education shall cause the posting of the inventory on their website to cease after a period of ninety days. At the end of the posting period, the department shall allow the general public to purchase any goods stored in the warehouse for discounted prices as determined by the department.

SECTION 6. All revenues generated by this Act shall be deposited into the general fund.

SECTION 7. This Act shall take effect upon its approval, provided that the lease of the warehouse that housed the department of education storeroom established by Act 89, Session Laws of Hawaii 1996, and repealed by Act 158, Session Laws of Hawaii 2002, is still in effect at the time of the approval of this Act.
