A BILL FOR AN ACT

 

relating to criminal law.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 710, part II, is amended by adding a new section to be appropriately designated and to read as follows:

"§710- Failure to perform statutory duties. Any procurement organization within the meaning of section 327-1 and any employee of such procurement organization who disregards the performance of the employee's duty as an employee of the procurement organization to cause the retrieval of gifts that are made irrevocable by section 327-2(h) shall be guilty of a violation of law subject to:

(1) A fine of not less than $10,000 for each failure to perform the employee's duty; and

(2) A sentence of imprisonment of not more than thirty days for each failure to perform the employee's duty."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
