A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-     School year; working days. (a) Notwithstanding any other law to the contrary, the school year for public school employees shall consist of not less than one hundred eighty working days; provided that each of the foregoing working days shall also be instructional days with students.

(b) This section shall apply to all elementary, middle or intermediate, and high schools, including new century charter schools and new century conversion charter schools, beginning with the 2004-2005 school year."

SECTION 2. Chapter 89, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§89-     School year; working days. (a) Notwithstanding any other law to the contrary, no collective bargaining agreement shall contain provisions that would shorten the school year for public school employees to less than one hundred eighty working days; provided that each of the foregoing working days shall also be instructional days with students.

(b) This section shall apply to all elementary, middle or intermediate, and high schools, including new century charter schools and new century conversion charter schools.

(c) In the event of a conflict with sections 89-10(d), 89-10.5, 89-10.6, 89-19, and 89-23, this section shall control."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2003.
