A BILL FOR AN ACT

 

RELATING TO NEW MOTOR VEHICLES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 249, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART . NEW MOTOR VEHICLE ENVIRONMENTAL IMPACT TAX

§249-    New motor vehicle environmental impact tax. (a) All new motor vehicles exempt under section 249-4 from the tax imposed in section 249-2 shall be subject to a new motor vehicle environmental impact tax; provided that the vehicle's net weight is greater than four thousand pounds and the purchase price or lease price inclusive of the vehicle's residual value, excluding all county and state taxes, exceeds $35,000.

(b) All new motor vehicles:

(1) For commercial use;

(2) Purchased or leased by the State or any county; and

(3) Purchased or leased for twelve months or longer by police officers of the State or any county that actually are used by them in their travel on official business,

shall be exempt from the tax imposed herein.

(c) The tax shall be levied by the county director of finance at a flat rate of:

(1) $750 for each new vehicle with a net weight of more than four thousand pounds and up to and including five thousand pounds;

(2) $1,000 for each new vehicle with a net weight of more than five thousand pounds and up to and including six thousand pounds; and

(3) $1,500 for each new vehicle with a net weight of over six thousand pounds.

§249-    Disposition of tax. All taxes collected under this part shall be paid into the natural area reserve fund established by section 195-9; provided that the funds paid into the natural area reserve fund shall be annually disbursed by the department of land and natural resources after joint consultation with the forest stewardship committee and the natural area reserves system commission in the following priority:

(1) The youth conservation corps established under chapter 193;

(2) The natural area partnership and forest stewardship programs; and

(3) Projects undertaken in accordance with watershed management plans pursuant to section 171-58 or watershed management plans negotiated with private landowners."

SECTION 2. This Act shall take effect on December 31, 2003.
