A BILL FOR AN ACT

 

RELATING TO TRANSPORTATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is a hazardous condition on the Haleiwa side of Waimea Bay, with the imminent possibility of rock slides and the collapse of Kamehameha highway due to erosion. The rock slide on the Kahuku side of Waimea Bay in 2000 is an indication of the immediate danger facing the area, which threatens injury and death to both residents and visitors. The 2000 rock slide caused financial hardship to businesses on the north shore and inconvenienced everyone living in and visiting the area. The State could face potential liability unless action is taken to stabilize Kamehameha highway and its surrounding terrain.

The purpose of this Act is to appropriate funds for a hazard assessment study of the portion of Kamehameha highway near Waimea Bay.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $200,000 or so much thereof as may be necessary for fiscal year 2003-2004 to conduct a hazard assessment study of the portion of Kamehameha highway near Waimea Bay.

The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

SECTION 3. The department of transportation shall present the hazard assessment study to the legislature no later than twenty days prior to the convening of the regular session of 2004.

SECTION 4. This Act shall take effect on July 1, 2003.
