A BILL FOR AN ACT

 

RELATING TO RENTAL MOTOR VEHICLE SURCHARGE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 251, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§251- County rental motor vehicle surcharge. (a) Any county by ordinance may authorize the executive branch of the county to assess a county surcharge on rental motor vehicles of not more than $5 a day, or any portion of a day that a rental motor vehicle is rented or leased. The rental motor vehicle surcharge shall be levied upon the lessor. The proceeds from the county surcharge shall be used only for highway or roadway development or improvements.

(b) The county surcharge shall be collected in the same manner and in addition to the collections made under section 251-2; provided that:

(1) The state director of finance shall distribute the county rental motor vehicle surcharge on a quarterly basis to each county in an amount equal to the county surcharge collected in each county; and

(2) The state director of finance may assess a reasonable fee on each county for administration purposes.

(c) The director, pursuant to chapter 91 and in consultation with the state director of finance, shall establish necessary procedures to effectuate this section, including reporting the amount of collections made in each county to the state director of finance."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on January 1, 2004.
