Description:

Requires office of elections to prepare a sample ballot to be mailed to each registered voter. Allows sample ballot to be mailed concurrently with any correspondence mailed to effect the purpose of section 11-17. Mandates sample ballot shall be identical to ballot used during election except for any marks the office deems necessary to state the ballot is not official.

A BILL FOR AN ACT

 

relating to elections.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§11-A Sample ballots; mailing; markings. (a) The office of elections shall prepare a sample ballot to be mailed to each registered voter during an election year at least thirty days prior to an election.

(b) The sample ballot shall be identical to the ballot used during an election, except for any marks or identification the office of elections deems necessary to state the ballot is a sample for educational purposes only and not for official use.

(c) The sample ballot may be mailed concurrently with any correspondence mailed by a county clerk to effect the purpose of section 11-17. If this option is used by the office of elections, each county clerk may seek reimbursement for any additional postage costs, if any, from the office of elections."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $_____________, or so much thereof as may be necessary for fiscal year 2004-2005, for the purposes of this Act.

SECTION 3. The sum appropriated shall be expended by the office of elections for the purposes of this Act.

SECTION 4. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect upon its approval.
