Description:

Prohibits the car alarm manufacturers and car dealers from causing to be sold or selling in the State alarm systems that cannot electronically notify the car owner that the alarm is being activated. Prohibits car owners from operating a vehicle that lacks electronic notification capability. Subjects violators to traffic code penalties (HB1372 HD1).

A BILL FOR AN ACT

 

RELATING TO MOTOR VEHICLE ALARM SYSTEMS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§291C- Motor vehicle alarm systems; required technology. (a) Effective July 1, 2005, no manufacturer of a motor vehicle alarm system that emits noise for more than three continuous minutes may cause to be sold or distributed in the State a motor vehicle alarm system that does not possess a component or device that electronically notifies the registered owner of the motor vehicle that the alarm has been activated.

(b) Effective July 1, 2005, no motor vehicle dealer shall sell a motor vehicle alarm system that emits noise for more than three continuous minutes, or sell a motor vehicle containing such an alarm system, that does not possess a component or device that electronically notifies the registered owner of the motor vehicle that the alarm has been activated.

(c) Effective July 1, 2005, no registered owner of a motor vehicle equipped with an alarm system that emits noise for more than three continuous minutes, which does not possess a component or device that electronically notifies the registered owner that the alarm has been activated, shall operate a motor vehicle on the public highways, until the alarm system has been removed or the motor vehicle has been retrofitted with an alarm system that electronically notifies the registered owner that the alarm has been activated.

(d) A person who violates this section shall be subject to the penalties set forth in section 291C-161."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2003.
