A BILL FOR AN ACT

 

relating to Noise pollution abatement within waikiki.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§712-A Noise abatement; designated area. (a) For purposes of this section:

"Waikiki" means that area on the island of Oahu bounded by the Ala Wai canal, the ocean, and Kapahulu avenue.

(b) It shall be unlawful for any person or persons within the boundaries of Waikiki, unless exempted under the terms of chapters 342F-4.5 or 342F-5, to:

(1) Engage in any activity, operate or cause to operate any equipment or apparatus which emits any noises or sounds exceeding 120 decibels from its point of origin, within 500 feet from the nearest point of any building; or

(2) For any person, in passing or through the district, to drive or operate any vehicle in such manner as to make or create any noise exceeding 120 decibels.

(c) Any person violating any provision of this article shall upon conviction be punished by a fine not exceeding $100.00 or by imprisonment not exceeding 30 days, or by both."

SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
