A BILL FOR AN ACT
relating to court interpreters.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 606, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§606-A Court interpreters. (a) The judge of the circuit court of each judicial circuit, or the administrative judge thereof as applicable, shall appoint one or more interpreters.
(b) The district judge of each judicial circuit, or the administrative judge, as applicable, shall appoint one or more interpreters.
(c) Notwithstanding any law to the contrary, court interpreters shall be officers of the court who shall be entitled to compensation as provided pursuant to section 608-1 or 608-2, as applicable; provided that court interpreters shall not be members of the civil service system of the State and shall be exempt from collective bargaining, executive order, executive directive, or rule."
SECTION 2. Section 608-1, Hawaii Revised Statutes, is amended to read as follows:
"§608-1 Personnel and expenses of circuit courts. The State shall pay the expenses of the several circuit courts and the salaries of [such] all officers and employees [as] that may be required by [such] the courts, including without prejudice to the generality of the foregoing, expenses of the family courts and agencies thereof. The judge or judges of the several circuit courts shall appoint [such] the officers and employees as [may be] required by the courts, including interpreters, and for which appropriations have been made by the legislature; provided that the officers and employees of the family court of the first circuit, including without prejudice to the generality of the foregoing probation officers, truant officers, and personnel of the detention home, shall be appointed by the judge of the family court under whose supervision the appropriations for the division shall be expended. Except as otherwise provided, the officers and employees shall be members of the civil service system of the State and shall be subject to chapter 76 and the appropriate collective bargaining agreement, executive order, executive directive, or rule."
SECTION 3. Section 608-2, Hawaii Revised Statutes, is amended to read as follows:
"§608-2 District court, salaries, expenses, etc. The salaries of the district judges, clerks, and other assistants and the expenses of the district judges shall be paid by the State. The judges shall have power to appoint such additional officers or employees as may be required by the courts, including interpreters, and for which appropriations have been made by the legislature. Except as otherwise provided, such officers and employees shall be subject to chapter 76 and the appropriate collective bargaining agreement, executive order, executive directive, or rule."
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2003-2004, and the same sum, or so much thereof as may be necessary for fiscal year 2004-2005, to provide compensation for court-appointed interpreters of the judiciary.
SECTION 5. The sums appropriated shall be expended by the judiciary for the purposes of this Act.
SECTION 6. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 7. This Act shall take effect on July 1, 2003.
