A BILL FOR AN ACT

 

RELATING TO SUBSTITUTE TEACHER PER DIEM RATE IN THE DEPARTMENT OF EDUCATION

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to provide for compensation of substitute teachers commensurate with educational training and academic qualifications. The current statute requires that all substitute teachers be paid at one per diem rate, regardless of qualifications, resulting in no recognition of completion of a State-approved teacher education program or attainment of a college degree. Due to federal No Child Left Behind mandates and state expectations to have highly qualified personnel in all instructional positions, this amendment proposes that the board of education be accorded responsibility for development of a classification and compensation plan that serves to recognize those highly qualified to promote student learning and achievement as well as to serve as an incentive for others to attain high educational qualifications. It replaces statutory linking of compensation levels to any classification or step of the teacher's bargaining unit salary schedule, as the teacher's schedule assumes attainment of a college degree; substitute teachers are not in the teacher's bargaining unit; and the salary schedule is subject to major changes during negotiations, such as renaming of classes and ranges and shredding, thus rendering specific statutory reference to steps or ranges obsolete or having unintended results.

SECTION 2. Section 302A-624, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) Effective July 1, 2003, the per diem rate or rates for substitute teachers shall be determined by the board of education based on the classification/compensation plan approved by the board."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2003.
