RELATING TO THE STATE PROCUREMENT OFFICE.

Suspends the state procurement office's procurement circular no. 2002-02 regarding purchases from Grainger Industrial Supply until public hearings are held; requires state procurement office to submit report to the legislature.

RELATING TO THE PUBLIC PROCUREMENT CODE.

Provides that the protest of an award of a contract under the public procurement code are to be based on a purchasing agency's failure to follow procedures established by the code or rules adopted by the policy board in awarding a purchase of goods, services, or construction.

RELATING TO SECTION 103D-1007, HAWAII REVISED STATUTES.

Extends the state taxpayer preference in the procurement code to joint ventures in which each participating contractor meets the statutory criteria.

Allows preferences for in-state contractor, made in Hawaii products, and recycled content product preferences to be applied cumulatively.

RELATING TO DESIGN PROFESSIONAL SERVICE CONTRACTS.

Amends the law governing the procurement of design professional services to: provide for a selection committee, rather than a screening committee, to evaluate persons included on a qualified list and rank at least three offerors for consideration by the purchasing agency head and require the names and qualifications of members of review and selection committees to be public information.

RELATING TO THE PROCUREMENT OF DESIGN PROFESSIONAL SERVICES.

Amends the public procurement code with respect to the procurement of design professional services by requiring the head of a purchasing agency in need of a particular service to designate a selection committee comprised of civil service employees to evaluate qualifications and performance data.

RELATING TO PROCUREMENT CODE.

Requires that after a construction contract is awarded, a pre-job conference is required between the state or county representatives, the prime contractor, and all subcontractors involved.

SB 1262

RELATING TO PROCUREMENT.

Establishes contracting preferences to enhance competition and promote the growth and development of small businesses. Section 5 requires the adoption of procurement rules and procedures to identify and set aside contracts suited for performance by small businesses that otherwise would not be able to obtain government contracts. Section 2 also requires that solicitations for certain large contracts include evaluation criteria that will encourage prime contractors to subcontract and maximize the involvement of Hawaii small businesses. Establishes a Procurement Institute to improve and enhance the efficiency, integrity and transparency of the State procurement process. Makes technical amendments to the sealed bidding provisions of the Procurement Code. Requires that an independent selection committee rank the applying professional service providers according to relevant criteria. And requires the awarding procurement official to negotiate award of the contract with the providers in the rank order set by the committee. Establishes contracting preferences to promote training and employment opportunities for disabled persons. Will allow agencies to make non-competitive awards of contracts for construction valued at $500,000 or less to organization serving disabled people.
