A BILL FOR AN ACT

 

relating to fundraising activities.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§11-__ Other prohibited activities. (a) It shall be unlawful for any person, including any public officer or employee, to solicit any political contribution from any person in:

(1) Any state or county room or building occupied in the discharge of official duties; or

(2) Any private office or open courtyard of the state capitol building.

(b) It shall be unlawful for any person, including any public officer or employee, to invite or allow any person to solicit any political contribution from any person in:

(1) Any state or county room or building occupied in the discharge of official duties; or

(2) Any private office or open courtyard of the state capitol building.

(c) The prohibitions of subsections (a) and (b) shall not apply to any person who pays a rental or other fee for the use of any public school or any other state or county facilities or grounds.

(d) For purposes of this section:

"Political contribution" means a contribution to a candidate, political party, or organization, for the purposes of influencing, interfering with or affecting the result of an election, and includes a gift, subscription, loan, advance, or deposit of money or anything of value, including a contract, promise, or agreement, whether or not legally enforceable, to make a contribution.

"Public officer or employee" means any person holding a position in the service of a jurisdiction, as defined in section 76-11, including:

(1) Members of boards and commissions; and

(2) Elected public officers irrespective of status or type of appointment.

The term is not limited to members of the civil service."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
