A BILL FOR AN ACT

 

RELATING TO ARRESTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 803-6, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) If a person fails to appear in answer to the citation; or if there is reasonable cause to believe that the person will not appear, a warrant for the person's arrest may be issued. [Wilful] A knowing failure to appear in answer to the citation may be punished by a fine of not more than [$100] $1,000 or imprisonment of not more than 30 days or both."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2002.
