A BILL FOR AN ACT

 

relating to students.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to require students to provide either a social security number or student visa prior to registering at department of education schools or the University of Hawaii. All social security numbers, student visa information, and other vital information obtained under this section shall be kept confidential by the department of education and the University of Hawaii, except when limited sharing of such information is determined to be in the best interests of the student. Such privacy measures are especially important in light of the rising occurrence of such crimes as identity theft.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"302A-    Student identification requirement for registration. No prospective student who is a citizen of the United States of America shall register to attend any elementary, middle, or high school of the department without providing the individual's social security number. No prospective student who is a foreign national residing in the United States of America shall register to attend any elementary, middle, or high school of the department without providing the individual's current student visa. All social security numbers, student visa information, and other vital information obtained under this section shall be kept confidential by the department of education, except when:

(1) Required pursuant to a court order; or

(2) It is construed to be in the best interests of the student, as determined by the department, to share such information with other state agencies or selected private contractors; provided that such agencies or contractors shall not disclose such information to the general public."

SECTION 3. Chapter 304, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"304-    Student identification requirement for registration. No prospective student who is a citizen of the United States of America shall register at the University of Hawaii without providing the individual's social security number. No prospective student who is a foreign national residing in the United States of America shall register at the University of Hawaii without providing the individual's current student visa. All social security numbers, student visa information, and other vital information obtained under this section shall be kept confidential by the University of Hawaii, except when:

(1) Required pursuant to a court order; or

(2) It is construed to be in the best interests of the student, as determined by the department, to share such information with other state agencies or selected private contractors; provided that such agencies or contractors shall not disclose such information to the general public."

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
