A BILL FOR AN ACT

 

relating to standardized insurance forms.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10A to be appropriately designated and to read as follows:

"§431:10A-    Standard claims forms. Effective July 1, 2005, an insurer shall utilize standard forms approved by the commissioner to process claims for payment or reimbursement of payment for services rendered under a policy of accident and sickness insurance."

SECTION 2. Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 1 to be appropriately designated and to read as follows:

"§432:1-    Standard claims forms. Effective July 1, 2005, a mutual benefit society shall utilize standard forms approved by the commissioner to process claims for payment or reimbursement of payment for services rendered under an individual or group hospital or medical service plan contract."

SECTION 3. Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§432D-    Standard claims forms. Effective July 1, 2005, a health maintenance organization shall utilize standard forms approved by the commissioner to process claims for payment or reimbursement of payment for services rendered under an individual or group contract for health care services."

SECTION 4. The insurance commissioner, in conjunction with the health insurance industry, shall develop standard health insurance claims forms modeled on forms utilized by the department of human services for the Medicaid program, no later than June 30, 2005.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect upon its approval, and shall be repealed on June 30, 2004.
