A BILL FOR AN ACT

 

RELATING TO AGRICULTURE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 150A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§150A-   Nonnative plants and animals. (a) Notwithstanding any other provision of law, it shall be unlawful for any person to knowingly introduce, or knowingly cause to be introduced, into the State any species of nonnative animal or plant from captivity.

(b) Notwithstanding any other provision of law, it shall be unlawful to knowingly sell, barter, trade, possess, distribute, transfer, transport, receive, or assist any person or business in the acquisition of any animal or plant species not authorized by the department for import into the State."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
