A BILL FOR AN ACT

 

RELATING TO HURRICANE SHELTERS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 127, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"127- Adoption of hurricane resistant shelter criteria; construction of new public school buildings. (a) The adjutant general shall adopt hurricane resistant shelter criteria in accordance with chapter 91 to regulate the plans, design, construction, and equipment of new public school buildings built after June 30, 2002, that are designated by the State or counties as hurricane shelters.

(b) Nothing contained in this section shall be construed to limit the authority of the State or counties in designating any public or private building as a public or private shelter or to limit the powers, rights, and immunities provided in chapter 128."

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:

"302A-   Construction of new school buildings; conformance with hurricane resistant shelter criteria. (a) All new school buildings planned, designed, constructed, and equipped after June 30, 2002, that are designated by the State or counties as hurricane shelters, shall be built in accordance with the hurricane resistant shelter criteria adopted by the adjutant general pursuant to section 127-   .

(b) Nothing contained in this section shall be construed to limit the authority of the State or counties in designating any public or private building as a public or private shelter or to limit the powers, rights, and immunities provided in chapter 128."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
