A BILL FOR AN ACT

 

RELATING TO FOOD LABELING.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 486, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

"486- Chocolate and cocoa products; minimum content and labeling requirements. (a) Notwithstanding section 486-119 and in addition to all other labeling requirements, all chocolate and cocoa products can be labeled, advertised, marketed, or described as:

(1) "Hawaiian";

(2) "Made in Hawaii"; or

(3) Terms of similar import indicating Hawaii as the source of the product,

only if one hundred per cent of the finished product is entirely of Hawaii origin.

(b) Each word in the identity statement in subsection (a) shall be contiguous and conspicuously displayed without any intervening material. Upper and lower case letters may be used interchangeably in the identity statement.

(c) A violation of this section shall constitute misbranding under section 486-118.

(d) For the purposes of this section, "chocolate and cocoa products" includes chocolate, cocoa, cocoa nibs, cocoa liquor, and cocoa butter.

(2) "Made in Hawaii"; or

(d) As used in this section, "cocoa beans" are the dried or fermented seeds of the species Theobroma cacao L or a mixture of these."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
