A BILL FOR AN ACT

 

RELATING TO REGISTRATION OF DIVORCES AND ANNULMENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 338-29, Hawaii Revised Statutes, is amended to read as follows:

"338-29 Registration of divorces and annulments. Before any decree of divorce or annulment of marriage is signed, the person applying therefor shall prepare, through the attorney representing that person or the clerk of the court if an attorney is not retained, a certificate[, on a form to be approved by the department of health] in such form and manner as prescribed by the department of health[, and file it with the clerk of the court]. The certificate shall contain such items of information as are [recommended by the National Center of Health Statistics and] approved by the department. Within [ten] three business days after the final decree of divorce or annulment of marriage is granted, the clerk of the court shall [endorse] enter upon the certificate, in such form and manner as prescribed by the department of health, the date of the decree and [shall forward the certificate to the department.] any change of names included in the decree pursuant to section 574-5(2)(B)."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
