A BILL FOR AN ACT

 

RELATING TO NOTARIES PUBLIC.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 456-9, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The attorney general shall charge and collect the following non-refundable fees for:

[(1) Issuing the original commission, $40; and

(2) Renewing the commission, $40.]

(1) Application for notary public commission, $10;

(2) Each examination, $10;

(3) Issuance of notary public commission, $40;

(4) Renewal of notary public commission, $40;

(5) Restoration of forfeited commission, $60;

(6) Commission name change, $10;

(7) Change in judicial circuit, $10; and

(8) Notary public manual, $3 if the manual is picked up at the notary public office or $3.85 if the manual is to be mailed.

Notwithstanding the foregoing, the attorney general may establish and adjust fees pursuant to chapter 91.

The foregoing fees collected by the attorney general shall be deposited into the notaries public revolving fund established by section 456-9.5, except that if that fund is terminated, the foregoing fees shall thereafter be deposited with the director of finance to the credit of the general fund."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
