A BILL FOR AN ACT

 

relating to police departments.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 52D-5, Hawaii Revised Statutes, is amended to read as follows:

"[[]52D-5[]] Powers of chief of police outside own county. The chief of police of each county and any duly authorized subordinates shall have and may exercise all powers, privileges, and authority necessary to enforce the laws of the State, in a county other than the county in and for which the chief has been appointed, if:

(1) The exercise of such power, privilege, and authority is required [in the pursuit of any investigation commenced] for any law enforcement purpose within the [county in and for which the chief has been appointed;] State; and

(2) The concurrence of the chief of police of the county in which the power, privilege, and authority sought to be exercised is obtained."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
